Agency of civil service under the President of the Republic of Tajikistan
The civil service is an integral part of the public administration system and contains legal norms regulating public-service relations. The adoption of the Constitution of the Republic of Tajikistan marked the beginning of the creation of a new system of statehood and created a favorable basis for the gradual improvement of the public administration system and the reform of the civil service. The Constitution of the Republic of Tajikistan recognizes a person, his rights and freedoms as the highest value, which is one of the generally accepted values of the civilized world. Among the rights enshrined in the Constitution of the Republic of Tajikistan (article 27) are the direct participation of citizens of the Republic of Tajikistan in public administration and the equal right to public service. This right is a sphere that determines the attitude of a citizen to the state, and at the same time represents the essence of public service as a profession. In accordance with the International Covenant on Civil and Political Rights, adopted in 1966, the equal right of citizens to enter public service is an integral part of constitutional law in many countries. Tajikistan has also adopted this universally recognized criterion in order to organize effective public administration and implement the principles of transparency, democracy and accessibility of State power to the people.The creation of effective public administration as the basis for sustainable economic development, poverty reduction and one of the main goals of Tajikistan's national development.Modern practice of statehood in developed countries shows that the implementation of public policy, including public service, depends on the competence, knowledge and skills, and a high level of professionalism of civil servants. The more civil servants have knowledge, skills and managerial skills, the more effective their professional activities are and the comprehensive development of the pillars of the state is ensured. The organization of effective activities is the mission of public administration, and it is necessary to attract honest people and competent specialists with modern knowledge, deep spirituality and high professional level to the civil service so that they can serve the interests of the people and the Motherland. The adoption of the Law of the Republic of Tajikistan dated November 13, 1998 No. 677 "on civil service" provided for the creation of an authorized body with special powers, in connection with which, in order to implement a unified state policy in the civil service, by Decree of the President of the Republic of Tajikistan dated January 25, 2001 No. 475, a new authorized body in the field of public administration of Tajikistan was created The Department of Public Service under the President of the Republic of Tajikistan. The structure of the central office of the Civil Service Administration consisted of management, departments of legal support of the civil service, personnel support of the civil service, development of qualification requirements and remuneration system for civil servants, analysis and information, administrative and economic activities. The establishment of this institution was one of the achievements of the period of state independence of the Republic of Tajikistan, it created a favorable basis for the formation of a new system of statehood, gradual improvement of the civil service and its reforms.The phased activities of the Civil Service Department under the President of the Republic of Tajikistan were aimed at selecting employees and training them by organizing theoretical and practical classes, analyzing and using the experience of the civil service of developed countries and developing departmental acts for the implementation of the activities of the department and its structural divisions. Also, in a short period, normative legal acts provided for by the Law of the Republic of Tajikistan dated November 13, 1998 "On Public Service" were developed and ratified. The founder of peace and national unity, Leader of the Nation, President of the Republic of Tajikistan, Dear Emomali Rahmon, in his Message to the Majlisi Oli of the Republic of Tajikistan dated April 22, 2002, stressed: "One of the most important issues of the day is the regulation of relations related to public service. They are the driving force and strengthening of the state and statehood. Therefore, they should be an example of the highest discipline, selfless and dedicated work. In order to enhance the role and position of civil servants in society, their discipline and level of knowledge, professional experience, selection of talented and dedicated personnel and bringing the structure of the country's departments to a certain system, the Civil Service Department under the President of the Republic of Tajikistan was established. This newly created body needs to start solving existing problems as soon as possible and ensure order and order in this direction." In order to conduct retraining, advanced training and internships for civil servants, increase the level of knowledge of civil servants and strengthen their contribution to the effectiveness of public administration, Decree No. 926 of the President of the Republic of Tajikistan dated October 9, 2002, the Institute for Advanced Training of Civil Servants of the Republic of Tajikistan was established at the Civil Service Department, which successfully functioned until 2013. In this round, the strategy for the reform of the public administration system of the Republic of Tajikistan dated March 15, 2006, No. 1713, the concept for the reform of the Civil Service of the Republic of Tajikistan dated June 1, 2007, No. 289 and the program for the reform of the civil service of the Republic of Tajikistan dated August 31, 2007, No. 448 were adopted.The Law of the Republic of Tajikistan "On Public Service" dated March 5, 2007 No. 233 was also adopted in a new version, which provided for strengthening the functions and powers of the Board. According to these documents, the issue of strengthening the capacity of the Civil Service Department, its local structures and the Institute for Advanced Training of Civil Servants was in demand in the civil service reform program of the Republic of Tajikistan. To this end, by Decree of the President of the Republic of Tajikistan dated June 9, 2007 No. 264, the regulations, the structure of the central office and the management plan of the Civil Service Department under the President of the Republic of Tajikistan were approved in a new edition, and its local structures in the regions and the city of Dushanbe were created with additional shifts and the Department of Public Administration of the Institute of Advanced Training. The total number of civil servants of the Department has been increased to 48, including 28 working units for the central office of Management. The founder of peace and national unity, the Leader of the Nation, the President of the Republic of Tajikistan, dear Emomali Rahmon, in his Message to the Majlisi Oli of the Republic of Tajikistan dated April 25, 2008, stated: "In order to form and improve the system of professional public service, a new version of the law " On Public Service" was adopted last year. For the full implementation of this law and the proper promotion of the state personnel policy, first of all, the Department of Public Service needs to develop and coordinate the system of public service of the Republic of Tajikistan and the necessary regulatory legal acts on this issue, as well as take effective measures to strengthen the unified system of public service. In this regard, the heads of all government agencies must ensure compliance with the provisions of the Law "On Civil Service" on competitive recruitment, certification, retraining, advanced training and social protection of civil servants. Managers and responsible employees of all levels of the civil service and in general all civil servants should always remember that the oath of office of the President of the country is awarded not only to the head of state, but also to each of them ten times. As a result of these instructions, the Concept of the State Personnel Policy of the Republic of Tajikistan No. 582 dated December 31, 2008 and the program of its implementation for 2009-2016 dated April 29, 2009 No. 252 were developed and approved, which play an important role in the implementation of the reform of public administration and public service. At the next stage of the development of the civil service and modern public administration of the Republic of Tajikistan, it was necessary to create conditions for the training of more highly qualified personnel with professional knowledge and skills. To this end, by Decree of the President of the Republic of Tajikistan No. 1502 dated August 26, 2013, the Institute for Advanced Training of Civil Servants of the Republic of Tajikistan was transformed into the Institute of Public Administration under the President of the Republic of Tajikistan, and in 2020, the Academy of Public Administration under the President of the Republic of Tajikistan was established on the basis of this institute. Annually, on the basis of the state order and the schedule of annual courses of professional training, retraining, advanced training and internship of civil servants with the involvement of civil servants of ministries, departments, local governments, jamoats of towns and villages and with the assistance of the Civil Service Agency, retraining, internship and advanced training courses for civil servants are conducted. Over the years, the problem of further formation and improvement of the functions of Public Service management, increasing its status and position in the public administration system has arisen. The new stage in the development of independent Tajikistan required that the Civil Service, as a personnel, legal, social and managerial institution between the state and society, play a more connecting role, contributing to the implementation of national priorities and the effective activities of state bodies. Thanks to the innovative policy of the leader of the nation, the legal basis for the activities of e-government was created, the Concept of e-government formation in the Republic of Tajikistan was approved by Decree of the Government of the Republic of Tajikistan No. 643 dated December 30, 2011, and the state program for computerization of central government bodies, local government bodies, self-government bodies of towns and villages for 2012-2015 was approved by decree of the Government of the Republic of Tajikistan from November 2, 2011 No.550, etc. they have been confirmed and enforced.In accordance with the Decree of the President of the Republic of Tajikistan dated November 19, 2013 No. 12 "On improving the structure of the executive body of State power of the Republic of Tajikistan" in order to form an effective system of public administration, the Office of Public Service under the President of the Republic of Tajikistan was transformed into the Agency of Public Service under the President of the Republic of Tajikistan. In accordance with the Decree of the President of the Republic of Tajikistan dated March 15, 2014 No. 179 "On approval of the Regulations on the Civil Service Agency under the President of the Republic of Tajikistan", the final number of Agency employees was 44 divisions, including 25 divisions in the Agency's central office, the structure of the Agency's central office consisted of management, legal support and control departments, management human resources, social protection of civil servants, organizational, analytical and information, human resources and office management departments, databases and testing, finance and accounting. In accordance with this provision, the main powers, functions and functions of the agency and the Director of the Civil Service Agency have been improved, and the reporting lines of the agency have been clearly defined. The Civil Service Agency has two deputy directors, including one first deputy, to discuss the organization of these important functions, the agency creates a board under the leadership of the Director of the Agency. The Agency's structure includes agency departments in Gorno-Badakhshan Autonomous Region, Sughd Region, Khatlon region, Dushanbe city, cities and districts of republican subordination, as well as the regional department of the Civil Service Agency under the President of the Republic of Tajikistan in the city of Kulyab. In this regard, in order to improve and strengthen, in accordance with the Decree of the President of the Republic of Tajikistan dated May 13, 2022 No. 384, the regulation, the structure of the central office and the management plan of the Civil Service Agency are established in the number of 52 units, including the central office of the Agency in the number of 33 units. The structure of the central office, depending on the functions and tasks of the Agency, includes management, departments of legal support, human resource management, social protection of civil servants, organizational and information, personnel, installation and control, database of civil servants, as well as Finance and accounting. According to the Regulation, the main activities of the Agency are the implementation of a unified state policy in the field of public service, regulatory regulation of the industry, organization, provision and control over the implementation of legislation in the field of public service and civil service, organization of retraining courses, advanced training and internships for civil servants, assistance in the implementation of guarantees and their encouragement.The main tasks of the agency were recognized as the development of proposals for the formation and improvement of the efficiency of the public service sector, the creation of an effective system of personnel selection and personnel management, coordination of the activities of state bodies on retraining, advanced training and internships of civil servants, ensuring the rights and legitimate interests of civil servants.
