Civil Aviation Agency under the Goverment of the Republic of Tajikistan

On Civil Aviation under the Government of the Republic of Tajikistan
(Government Resolution of the Republic of Tajikistan No. 536 dated November 2, 2018)

Pursuant to Article 12 of the Constitutional Law of the Republic of Tajikistan "On the Government of the Republic of Tajikistan" and to improve the state management system in the field of civil aviation of the Republic of Tajikistan, the Government of the Republic of Tajikistan resolves:

1. To establish the Civil Aviation Agency under the Government of the Republic of Tajikistan by reallocating:

   • 13 staff positions from the Civil Aviation Department of the central apparatus of the Ministry of Transport of the Republic of Tajikistan;
   • 14 staff positions from the Department of Supervision and Regulation of Air Transport of the State Service for Supervision and Regulation in the Transport Sector;
   • and 8 staff positions from the Department of Air Transport Certification of the State Unitary Enterprise "Certification Center for Works and Services in the Transport Sector."

2. Approve the Charter, structure, and list of enterprises and other organizations within the system of the Civil Aviation Agency under the Government of the Republic of Tajikistan (Annexes 1, 2, and 3).

2.1. Establish the maximum number of staff positions for the Civil Aviation Agency under the Government of the Republic of Tajikistan, financed from the republican budget, at 35 (excluding service personnel).

2.2. Authorize the Civil Aviation Agency under the Government of the Republic of Tajikistan to have one Deputy Director and a board consisting of 5 members.

2.3. Establish a limit of 2 official vehicles for the Civil Aviation Agency under the Government of the Republic of Tajikistan.

3. The financing of the Civil Aviation Agency under the Government of the Republic of Tajikistan shall be carried out within the funds allocated in the republican budget and other sources in accordance with the legislation of the Republic of Tajikistan.

4. Amend Government Resolution No. 250 dated May 6, 2011, "On the Ministry of Transport of the Republic of Tajikistan" as follows:

   • In paragraph 2, replace the numbers "376" and "90" with "363" and "77," respectively;
   • In Annex 2, "Structure of the central apparatus of the Ministry of Transport of the Republic of Tajikistan," approved by Government Resolution No. 250 dated May 6, 2011, "On the Ministry of Transport of the Republic of Tajikistan," remove paragraph 4;
   • Renumber paragraphs 5–11 as paragraphs 4–10.

5. Amend Government Resolution No. 107 dated March 3, 2007, "On the State Service for Supervision and Regulation in the Transport Sector" as follows:

   • In paragraph 2, replace the numbers "314" and "50" with "300" and "36," respectively;
   • In Annex 2, "Structure of the central apparatus of the State Service for Supervision and Regulation in the Transport Sector," approved by Government Resolution No. 107 dated March 3, 2007, "On the State Service for Supervision and Regulation in the Transport Sector," remove paragraph 2.

6. The Ministry of Transport of the Republic of Tajikistan and the Civil Aviation Agency under the Government of the Republic of Tajikistan shall, within two months, submit proposals for amending and supplementing sector-specific regulatory legal acts of the Republic of Tajikistan.

7. The State Committee on Investments and State Property Management of the Republic of Tajikistan shall take measures to allocate premises for the Civil Aviation Agency under the Government of the Republic of Tajikistan.
