The history of the creation and development of the Prosecutor's Office of the                                                     Republic of Tajikistan

A thousand years after the collapse of the powerful Samanid state, the Tajik people had the opportunity, at least at the level of an autonomous republic, to begin building the real foundations of their statehood. It was a difficult task, but the Tajik people, striving for their dream, managed to overcome many difficulties and adversities. On October 14, 1924, the Second Session of the All-Russian Central Executive Committee approved the resolution of the Central Executive Committee of the Turkestan Autonomous Soviet Socialist Republic On National Partition. In accordance with this decree, the Tajik Soviet Socialist Autonomous Republic was formed as part of the Uzbek SSR. Later, by the decision of the Revolutionary Committee of the Republic of Uzbekistan dated November 26, 1924, the Provisional Government of Tajikistan was formed, which initially performed the functions of the revolutionary committee. On December 7, 1924, at a meeting of the Revolutionary Committee of the Tajik Autonomous Republic, the issue of establishing the People's Commissariat of Justice, the State Prosecutor's Office, as well as people's courts was discussed. As a result, a number of relevant decisions were made. One of them was the date of December 14, 1924, on the establishment of the People's Commission of Justice and the State Prosecutor's Office of the Republic of Tajikistan. Thus, the Prosecutor's Office of the Republic has become one of the independent departments of the People's Commissariat of the Republic of Tajikistan. The People's Commissariat of Justice and the Prosecutor's Office of the Republic began their work on December 22, 1924. It is from this day that the formation and further development of the Prosecutor's Office of the Republic of Tajikistan begins. Tojiddin Saifiddinov is appointed to the post of Chairman of the People's Commissariat of Justice. Also, on February 18, 1925, he was confirmed as the first prosecutor of the Tajik SSR, in which position he would serve until 1927. In 1927, by the decision of the Bureau of the Central Committee of the CPSU (b) of the Tajik SSR, Mullojon Sadulloev was nominated for the post of prosecutor of the Republic. On December 5, 1929, the Republic of Tajikistan entered a new stage of its historical development, gaining state independence as part of the former Soviet Union. This meant that a period of sovereignty had begun in the activities of the Prosecutor's Office of the Republic. M. Sadulaev was again appointed prosecutor of the Republic and held this position until 1931.In 1931-1935, comrades ch. Imomov, S. Khodjierov, A.Rosenberg and A. Lebedev served as Prosecutor of the Republic of Tajikistan. Due to the abolition of districts by the decree of the Central Executive Committee and the Council of People's Commissars of the Tajik SSR dated June 20, 1930, the district prosecutor's offices were disbanded, and in their place regional, city and district prosecutor's offices, as well as the Prosecutor's Office of the Gorno-Badakhshan Autonomous Region, were formed. In large cities and districts of great economic and political importance, the position of Assistant prosecutor was established. District prosecutors were appointed by regional prosecutors. The duties of the prosecutors of the abolished districts were transferred to the district prosecutors. Investigators were appointed by district commissions or city councils on the proposals of district prosecutors. On June 28, 1930, by a resolution of the Central Executive Committee, the CIS and the Tajik SSR, the Regulation "on the judicial authorities of the Tajik SSR" was adopted. According to it, investigators were required to conduct an investigation, direct and control the activities of other investigative bodies and act as prosecutors in court. The Prosecutor's Office of the Republic exercised strict control over the execution of decisions of the party and the government, took measures to prevent any violations of the law that could weaken the foundations of the economy. The Prosecutor's Office also actively fought against Canaanism, abuse, dissent, violation of the rights and legitimate interests of the people. Took measures for timely protest and cancellation of any orders and decisions of authorities, public organizations and cooperatives that contradict the law and harm the interests of citizens. On the basis of the decree of the Central Executive Committee and the CIS of the USSR dated June 20, 1933, the Prosecutor's Office was separated into an independent body from the People's Commissariat of Justice. The Prosecutor's Office of the USSR was entrusted with the overall management of the activities of the Union prosecutor's offices. But the staff of the prosecutor's offices of the Union republics were subordinate to both the prosecutors of the USSR and the KHA of the republic for several more years. This made it difficult to organize the work on the selection, placement and training of employees of prosecutorial and investigative bodies. By the decree of the Central Executive Committee and the Council of People's Commissars of the USSR dated June 20, 1936 "On the formation of the People's Commissariat of Justice of the USSR", the prosecutors of the Union republics were withdrawn from the NKVD and completely subordinated to the prosecutor of the USSR. Since that period, the structure of the organization of the Prosecutor's Office has been strictly centralized. In 1946, the Supreme Soviet of the USSR awarded the Prosecutor of the USSR the title of Prosecutor General of the USSR. In 1964, the Prosecutor's Office of the Tajik SSR consisted of one city prosecutor's office and 5 district prosecutor's offices of the Gorno-Badakhshan Autonomous Region; 9 city prosecutor's offices of central subordination; 23 district prosecutor's offices; 4 prosecutor's offices of military units, a total of 42 prosecutor's offices. During the formation of the Prosecutor's office of the republic, its further development and improvement were accompanied by the fruitful activities of S. Ismailzoda, A. Rakhmonov, G. Imomov, M. Sadulloev, T. Saifuddinov, S. Khodzhierov, N. Zhogin, V. Among them were such well-known industry figures as Bulargin, because they had difficult tasks to create a prosecutor's office base in Tajikistan. During this period, there were comrades in the office of the Prosecutor of the Republic.V.Ilyin (1935-1938), A.Ya.Romanov (1938-1948), N.V.Zhogin (1948-1958), H.H.Huseynov (1958-1961), V.A.Bulargin (1961-1973), A.A. Shchelochinin (1973-1981), Yu.N.Shcherbakov (1981-1986), G.S.Mikhaylin.(1986-1990) and N.H.Khuvaidullaev (1991-1992). In January 1966, the honorary professional title "Honored Lawyer of the Republic of Tajikistan" was established. This name was given to jurists who served on the path to establishing the rule of law and achieved outstanding results in investigations. From 1967 to 1990, 35 employees of the prosecutor's office were awarded this honorary title, 20 employees of the prosecutor's office were awarded the badge "Honorary Employee of the Prosecutor's Office" for conscientious and long service in the prosecutor's office. In 1991, the Republic of Tajikistan declared its full independence and sovereignty. The Tajik state has entered a new historical period of its development, entered a period when drastic changes took place in the activities of the prosecutor's office, and the sense of responsibility of its employees has increased to a higher level. The events of 1990-1994 became a serious test for the State of Tajikistan. During these years, he became one of the most revered and revered. H. Huvaidulloev (1991-1992) - the first Prosecutor General of independent Tajikistan. The historic 16th session of the Supreme Council of the Republic of Tajikistan, convened at the request of the Popular Front and the majority of the people of the Republic in November 1992, restored the constitutional order. At the meeting, M.S. Salekhov was appointed as the Prosecutor General of the Republic of Tajikistan. During the investigation and disclosure of crimes committed during this period, a Crime Investigation and Disclosure Team was created under the leadership of M.S.Salekhov and got down to business. 35 investigative groups consisting of 250 employees carried out an operational investigation of the Prosecutor's Office, the Ministry of Justice and the Ministry of Internal Affairs, carried out a lot of work on organizing the fight against crime, investigating and solving crimes. During this period, the law "On the Prosecutor's Office of the Republic of Tajikistan" was adopted and put into effect in accordance with Resolution No. 653 of the Supreme Council of the Republic of Tajikistan dated April 30, 1992. According to this Law, the functions of the Prosecutor's office are to ensure the rule of law, strengthen the rule of law and the rule of law in order to protect the independence and sovereign rights of the Republic of Tajikistan; socio-economic, political and other rights and freedoms of citizens; the foundations of the Democratic structure of State power, the legal status of local Councils of People's Deputies, State bodies and public organizations. The Prosecutor's Office of the Republic of Tajikistan, along with legislative, executive, administrative and judicial bodies, acquired an independent form of state activity, and during this period the main directions of its activities, determined by law, were as follows:: - control over the observance of laws by authorities and public administration, enterprises, institutions, organizations, officials, citizens, etc. (general control); - control over the observance of laws by bodies fighting crime and other offenses, as well as bodies of inquiry and preliminary investigation; - control over compliance with the laws during the consideration by the courts of civil, criminal cases and cases of administrative offenses and economic disputes in arbitration courts, as well as when making decisions, sentences, appointments and contracts; - control over the implementation of laws in places of detention, in places of pre-trial detention, in the execution of punishments and other coercive measures determined by the court; - control over the observance of laws in military administration bodies and institutions; - investigation of crimes. The Prosecutor's Office also took part in the development of measures to curb crimes and offenses, in the work on improving and clarifying laws. With the progress of society, the Constitutional Law of the Republic of Tajikistan "On the Prosecutor's Office of the Republic of Tajikistan" was adopted on March 11, 1996 and in a different version on July 25, 2005 to further strengthen prosecutorial supervision on the way to strengthen the rule of law, the rule of law and the fight against crime.
