The Constitution and other applicable laws of the Republic of Tajikistan provide for a special procedure in relation to the activities of justice. Article 2 of the Constitutional Law of the Republic of Tajikistan "On Courts of the Republic of Tajikistan" states that the courts administer justice. When considering civil, judicial, economic and administrative cases, judges are independent and obey only the law. State authorities have no right to assign tasks to the court that are not provided for by the legislation of the Republic of Tajikistan. All judges in the Republic of Tajikistan have a single status, differing only in their powers and competence. The current legislation establishes that the court administers justice by considering civil, criminal, economic and administrative cases in court sessions. In any case, the court is obliged to defend the interests of the law and protect it from any encroachments. In court sessions, the subject may be only those cases that have entered the judicial proceedings. The only way to administer justice is through a court hearing. Thus, justice in its original meaning is the application by the court of legal norms in relation to disputes and other legal issues in constitutional, civil, criminal, economic and administrative cases in court sessions. Article 8 of the Code of Criminal Procedure of the Republic of Tajikistan (hereinafter abbreviated as CPC) establishes that justice in criminal cases is administered only by the court. No one can be found guilty of committing a crime without a court decision and contrary to the law, and also cannot be subjected to criminal punishment. One of the attributes of justice is that the decision, the decision, the ruling of the court are made on behalf of the state. And this property obliges all persons to whom the court decision and censure are directed to unconditionally comply with its requirements. If they are not performed voluntarily, they are enforced by the State. The court's act must be lawful and justified. If a decision, decision, or definition does not comply with the law, it is canceled or changed. The purpose of justice is not only to punish and enforce, but also to ensure its educational effect. The courts of the Republic of Tajikistan direct their activities towards establishing legality and ensuring social justice.
